<a href="https://www.flyingeze.com/category/covid-19" target="_blank">COVID-19</a> vaccine passports and proof of vaccination are currently hot topics in Alberta.
On Thursday, the Alberta government released a <a href="https://www.alberta.ca/proof-of-vaccination-faq.aspx" target="_blank">proof of vaccination FAQ page</a>, where the province doubled down on its stance of not implementing rules that require people to prove they are vaccinated to access certain services.
One particular line on the page caught some attention from some who look at the issues closely.

&#8220;I find it frustrating from a policy level and frustrating from a legal perspective too,&#8221; said Timothy Caulfield, Canada research chair in health law and policy at the University of Alberta, .
The line that raised eyebrows for some noted that &#8220;private businesses and municipalities’ decisions may be subject to legal challenges by individual Albertans.&#8221;
The statement was an odd one to include on a frequently-asked-questions page, Caulfield said.
&#8220;Anyone can sue,&#8221; he said. &#8220;That&#8217;s something that can happen in any space at any time. That doesn&#8217;t mean you&#8217;re going to be successful. &#8221;
Lorian Hardcastle, an associate professor in the Faculty of Law &amp; Cumming School of Medicine at the University of Calgary, commented on the statement as well.
&#8220;It&#8217;s less about them thinking that businesses and municipalities have significant legal exposure, but more a political statement to distance themselves from vaccine passports, which they&#8217;ve been opposed to all along,&#8221; she said.

Both Caulfield and Hardcastle indicated they believe that there are limited legal risks when it comes to mandating proof of vaccination. Hardcastle said, generally, the main legal concern comes from people who can&#8217;t be vaccinated due to medical conditions.
&#8220;Businesses&#8217; main obligations are under human rights law and not to discriminate against people with health conditions,&#8221; Hardcastle said.
While businesses are not to discriminate against those who medically cannot be vaccinated, Hardcastle suggested that same principle does not apply to those who simply choose not to get the jab.
Privacy policies could also be an area where a legal challenge could unfold but Hardcastle said she believes that would be unlikely.
&#8220;Businesses and municipalities already have privacy policies in place and policies for the collection of information,&#8221; she said.
&#8220;In this case, as long as they ensure they are following privacy law requirements in terms of collecting this information and whether they store it, the legal risk is also very limited.&#8221;
Caulfield and Hardcastle both pointed out that businesses have already taken steps to accommodate those who cannot get vaccinated, by offering services like curbside pickup which are now commonplace.
&#8220;There definitely are legal and ethical things to consider,&#8221; Caulfield said. &#8220;But are these clearly illegal or legally problematic to the point where the government should be warning businesses in their frequently asked question? No.&#8221;

Hardcastle said she believes the risk will only get smaller as proof of vaccination becomes more commonplace.
&#8220;I think anybody worries to be the first one or second one to implement these kinds of rules,&#8221; she said. &#8220;But as it becomes more and more commonplace, I think there&#8217;s more comfort in doing that and that legal risk seems even smaller.&#8221;
The Lethbridge Chamber of Commerce is hoping to hear from local businesses on the subject.
A survey was launched on Wednesday for business owners and operators.
&#8220;It was initiated by some of our members being concerned over what British Columbia decided to do as a province,&#8221; said Lethbridge Chamber of Commerce CEO Cyndi Vos. &#8220;So we thought we&#8217;d be on the proactive side of things.&#8221;

British Columbia announced Monday that it will require <a href="https://www.flyingeze.com/tag/vaccine-passport" target="_blank">proof of vaccination</a> for people attending certain social and recreational events.
Less than 24 hours after the survey was launched, Vos said the Chamber of Commerce already had close to 300 responses. At that point, about 75 per cent of responses were against requiring proof of vaccination.
&#8220;What we&#8217;re doing at this point is not making a statement, not making a stance, we&#8217;re simply gathering intelligence,&#8221; she said.
Despite the Alberta&#8217;s current stance, Vos said she recognizes that things can quickly change. Instead of responding to issues, she wants to solve them and be ready to have educated discussions based on what business owners are saying.
&#8220;Business right now is just getting back into the groove of being in business and they just don&#8217;t want hurdles,&#8221; said Vos. &#8220;They want accurate information for the safety of their business, for the safety of their employees and their patrons.&#8221;

Court heard that the former captain of the men&#8217;s hockey team at Mount Royal University in Calgary ate magic mushrooms at a house party in January 2018.
He then broke into the home of professor Janet Hamnett and hit her with a broom handle.
The original trial judge had ruled that evidence supported the defence argument that Brown had experienced automatism and was not in control of his actions.

The Appeal Court reversed the decision by Court of Queen&#8217;s Bench Justice Michele Hollins and concluded Brown is guilty of aggravated assault and is to return to court for sentencing.
One of the court&#8217;s three judges, Justice Ritu Khullar, noted that, in 1995, Parliament debated the defence of self-induced intoxication automatism in crimes of violence.
She said Parliament agreed that the voluntary consumption of drugs is reckless behaviour and that people have to be accountable for the unintended consequences of their actions.
&#8220;In this case, holding the appellant accountable for his violent attack against Ms. Hamnett is an important step in recognizing Ms. Hamnett&#8217;s self-worth and dignity,&#8221; Khullar wrote.
&#8220;It is demonstrably justifiable to hold persons like the respondent accountable for their decisions to consume substances known to affect human behaviour,&#8221; Justice Frans Slatter added.

The veteran singer was born on October 1, 1960, and hails from Abia State. His music style became known as Zigima Sound — a genre which became popular in the Eastern part of Nigeria in the early 1980s.
The genre is a mix of traditional Nigerian music and Igbo highlife infused with chanted vocals. Bright Chimezie used it to revolutionise the musical structure in Nigeria with lyrics that focused on the social issues of the country in a rather funny way.
He made songs like &#8216;Ube Nwanne&#8217;, &#8216;because of English&#8217;, ‘African style’, among others. His album, Respect Africa, brought him to the limelight as he used these songs to ridicule problems in society.
Chimezie is also known for his dance steps, popularly known as legwork. His stylish way of mixing excellent steps and a warning chant gave him the title &#8216; the duke of African music.

Legendary singer Bright Chimezie celebrates son’s graduation from law school

A federal judge in Washington DC has ordered a man accused of participating in the U.S. Capitol riot on January 6 to unlock his laptop &#8220;with his face,&#8221; after prosecutors argued that the laptop likely contains video footage that would incriminate him in the attempted insurrection.
Guy Reffitt was arrested in late January, three weeks after he participated in the riot, and has been in jail since. He has pleaded not guilty to five federal charges, including bringing a firearm to the Capitol grounds and a charge of obstructing justice. His Windows laptop was one of several devices seized by the FBI, which investigators said was protected with a password, but that it could also be unlocked using Reffitt&#8217;s face.
Prosecutors said forensic evidence suggested that the laptop contained gigabytes of footage from Reffitt&#8217;s helmet-worn camera that he allegedly used to record some of the riot, and asked the court if it could compel Reffitt to sit in front of the computer to unlock it.
Reffitt&#8217;s lawyer told the court that his client could &#8220;not remember&#8221; the password, but the court sided with the government and <a href="https://www.documentcloud.org/documents/21016668-us-vs-reffitt" target="_blank">granted the motion to compel</a> his biometrics. Reffitt&#8217;s lawyer told CNN, which <a href="https://www.cnn.com/2021/07/21/politics/capitol-rioter-unlock-laptop/index.html" target="_blank">first reported the court order</a>, that the laptop is now unlocked.
The government took advantage of a loophole in the Fifth Amendment, a constitutional right that grants anyone in the U.S. the right to remain silent, which includes the right to not turn over information that could implicate themselves in a crime, <a href="https://techcrunch.com/2019/11/21/court-police-suspects-passwords/" target="_blank">such as a password</a>. But some courts have ruled that those protections don&#8217;t extend to a person&#8217;s physical attributes that can be used in place of a password, such as a face scan or fingerprint.
In Reffitt&#8217;s indictment, the FBI said as such, claiming compelling Reffitt to biometrically unlock his computer &#8220;would not run afoul of the defendant&#8217;s Fifth Amendment right against self-incrimination.&#8221;
Courts across the U.S. are still divided on the reading of the Fifth Amendment and whether or not it applies to the compelled use of a person&#8217;s biometrics. The U.S. Supreme Court isn&#8217;t likely to address the issue any time soon, rejecting two petitions in as many years to rule on the matter, leaving it largely up to the states to decide.

The Law Society of Alberta says criminal charges may be warranted against a lawyer who allowed sexually explicit photos of a woman to be included as part of an affidavit in a custody case.
The self-governing body has sanctioned lawyer Karen Herrington of Sherwood Park, Alta., for bringing the administration of justice into disrepute and failing to provide competent legal services. She has been suspended for one month and ordered to pay $5,400 in costs.
Herrington was representing the husband in a common-law custody dispute.

The law society says the husband sent an affidavit to Herrington that was aimed at preventing his former partner from leaving the province and included intimate photos of her.
Herrington asked other members of her law firm what she should do, but ultimately decided to include the pictures in the affidavit, the regulator says.
&#8220;It was thought by Ms. Herrington that the pictures showed a pattern of behaviour from the wife and that she needed the affidavit for the emergency application the next morning,&#8221; Ryan Anderson from the law society wrote in the ruling.
&#8220;She consulted other lawyers in her office for their advice and made this decision to proceed. This does not leave Ms. Herrington blameless, but goes to show this was not a simple situation,&#8221; he said.
&#8220;Ms. Herrington appears to be a capable lawyer who made a poor choice.&#8221;
The opposing lawyer asked that the nude photos of his client be removed. They were blacked out before being filed in court.
Herrington admitted her guilt in that she failed to provide legal services to the standard of a competent lawyer and said it was an error to include the nude and explicit pictures.
Law society lawyers noted that Herrington may have broken the law under the Criminal Code for publication of an intimate image without consent.
They recommended the file be sent to the Alberta justice minister to see if charges are warranted.
&#8220;The Committee finds that there are reasonable and probable grounds that Ms. Herrington contravened Section 161.1 of the Criminal Code and as such we are obligated to make a referral to the Solicitor General,&#8221; the panel found.
&#8220;Ms. Herrington may very well have a defence but that is not up to our committee to decide.&#8221;
There was no immediate response to a request for comment from the office of Justice Minister Kaycee Madu.

Alberta lawyer suspended for allowing nude photos in custody case

A therapist in Yarmouth, N.S., who was recently accused of sexually assaulting one of his patients, was able to continue practicing after he was charged with another sexual assault two years ago.
Dominic Jacob Deveau, 46, was arrested on May 14 after a patient alleged she had been sexually assaulted by her therapist in December 2020.
He was charged with sexual assault and released on a number of conditions, including that he does not provide professional counselling or therapeutic services.
But that wasn’t one of his conditions when he was first arrested and charged with sexual assault in April 2019 after a woman reported he assaulted her while on a drive. That meant there was nothing stopping him from continuing to practice.

A week after he was arrested for the most recent sexual assault charge, Deveau was charged for allegedly breaching that condition.
“We were notified that he was continuing his practice, which led to the charge,” said RCMP spokesperson Lisa Croteau.
The allegations have not been tested in court and Deveau’s lawyer, Phil Star, declined to comment further on the case.
“My client also does not wish to be interviewed as per my advice to him,” he said in an email.
For a licensed therapist, being charged with a crime can lead to their licence being suspended — but people don’t actually need to be licensed in the first place to operate a counselling or therapy service.
<h2>Act of counselling ‘difficult to define’</h2>
Deveau’s professional website has been taken down, but an archived version from February 2020 said he had “extensive experience with clients over the years who have suffered extreme to minor trauma, addictions, mood disorders, marital issues, and more.”
The website also said he was a Canadian certified counsellor (CCC) and a professional member of the Canadian Counselling and Psychotherapy Association, though that doesn’t act as a regulatory or licensure body in Nova Scotia.

John Hubert, the executive director and registrar of the Nova Scotia College of Counselling Therapists, said while counselling therapists do have title protection – which means you need to be licensed to advertise yourself as a “counselling therapist” or “registered counselling therapist” – the act of counselling therapy itself isn’t protected.
It&#8217;s the same case for psychology &#8212; people can’t call themselves a “psychologist” or advertise “psychology” services unless they are registered with the Nova Scotia Board of Examiners in Psychology. But singular terms like “counsellor,” “therapist,” and “psychotherapist” are not licensed titles.
“We don’t have the prohibition on the practice of the things that go into counselling … You just can’t call yourself certain things while you’re doing it,” said Hubert in an interview. “And so it does open itself up to abuse, for sure.”
Hubert noted there is “good historical reason” for this. For instance, people like social workers and nurses can provide forms of therapy to people, even though they’re not registered therapists.
“So, it’s difficult to define exclusively what the act of counselling therapy would be because it overlaps with so many other legitimate scopes of practice with other health professions,” Hubert explained.

But in those cases, health professionals would be regulated in some other capacity, and, more importantly, the public would have access to a complaints process.
For anyone else, there isn’t much oversight, said Hubert.
In Deveau’s case, he was licensed by the college in 2017 as a registered counselling therapist candidate, a supervised role similar to an internship or residency. His candidacy lapsed at the end of March 2019 and he was no longer authorized by the college to practice.
On May 5 of this year, Hubert said the college was made aware of allegations that Deveau’s website improperly listed his “counselling therapy” services, even though it’s a protected title. That prompted the college to issue a public notification about Deveau on its website.

Hubert noted the importance of trust in a therapist-client relationship and said these kinds of situations can be “incredibly damaging.”
“It’s a very intimate relationship. I mean, when you’re in front of a counsellor, you’re telling very intimate details about your life, typically problems with a lot of emotional content,” he said, adding that while the college does encourage people to research the professionals they’re seeing, there is some public confusion over what regulations they are subject to.
“It adds a layer of vulnerability to the already vulnerable,” said Hubert.
<h2>Limited resources</h2>
When it comes to unlicensed therapists, there isn’t much oversight from the province, either.
In an email, provincial spokesperson Heather Fairbairn said the province does not play a role in the provision of unregulated or unlicensed services.
“We encourage Nova Scotians to do their research when seeking counselling services and use licensed, regulated practitioners,” Fairbairn wrote.
But that advice isn’t especially easy to follow in a small town like Yarmouth – with a population of around 7,000 – where mental health resources are “extremely limited,” said Trish McCourt, the executive director of the Tri County Women’s Centre.

The centre, which operates out of Yarmouth, Digby, and Shelburne, offers services and programming related to community services, housing, food security, and counselling.
They have a therapist who works specifically with survivors of sexual assault, but she has “a waitlist equivalent to her workload,” said McCourt.
She said accessing private mental healthcare services in the region is also a challenge.
“Mental health and addictions, the department, are really only able to help people who are deemed to be in a moderate to severe mental health or addictions diagnosis, and everyone else is referred to community [organizations],” said McCourt.
“But the resources aren’t in the community. We don’t have the capacity to hire someone with the appropriate credentials to deal with those kinds of needs, because the funding’s not available to community organizations to do that work.”

Because of that, many people requiring mental health services don’t have the luxury to shop around, said McCourt.
She said she felt “alarm” and “a real frustration with the system” when she found out Deveau was allowed to continue to practice therapy after his 2019 sexual assault allegation.
“I believe very strongly in the court process and that people be given their due process and not be necessarily treated as a criminal before they’ve gone through the entire court process and been convicted,” she said.
“But there are different types of crimes and some crimes put people at much greater risk than others.”
McCourt believes more oversight is needed in the industry and there should be better access to public mental health-care services in the region.
She added that in a small community like Yarmouth, a situation like this can have wide-reaching impacts.
“Even the simple fact that I’m much less likely to send someone to a private practice therapist, because the risk is higher, is having an impact on other people’s livelihood and access to services,” she said.
In the release announcing Deveau’s arrest this month, the RCMP said they believe there may be more victims and asked anyone with more information to contact the police.
Deveau is scheduled to make an appearance in Yarmouth Provincial Court on July 19 at 9:30 a.m., where he is expected to enter an election and/or plea for the charges.

Medical experts say the Federal and state governments should enact a law that will mandate hospitals to accept medical investigations done on patients in any accredited laboratory facility in the country.
According to the experts, this will reduce unethical practices in the medical evaluation of patients and also cut out-of-pocket payments for healthcare.
PUNCH HealthWise reports that when patients are referred to other hospitals from a health facility, the referral centres routinely reject the medical tests the patients bring from the first-contact hospitals, and generally make them to go through the same set of tests either at the referral facilities or at any other one the hospitals work with if they have no standard laboratories of their own.
Patients who brought the issue to our correspondent’s notice complain that, apart from the concerns about repeated exposures to sometimes dangerous medical tests such as x-rays at close intervals, the attendant out-of-pocket payments are a disincentive for seeking medical care in the hospital.
They suspect that hospitals that make patients repeat same tests when there is one they could work with, do so out of greed.
Experts who spoke with PUNCH HealthWise on the issue note that it is unethical for a physician to ask a patient to do a test when it is completely unnecessary, stressing that a test should only be done when it is needed.
Speaking with our correspondent on why some healthcare providers are reluctant to use same tests carried out on patients by another hospital, the National President,Guild of Private Medical Laboratory Directors of Nigeria, Dr. Elochukwu Adibo, said that an“ethically practising” physician should not request for a test from a patient for financial purposes.

Adibo said medical investigations are called for based on clinical indications and considerations.
“If there is need for a repeat test, it has to be done by the patient. But when it is intentionally done to shortchange the patient, it is evil and we don’t condone it. We speak against it.
“This is  why we have accredited laboratories and they are registered with the state and guided by extant laws. If there is any concern about the result of a test done by an accredited lab, the physician should call the laboratory facility for clarification, instaed of telling the patient to repeat the same test.
“There should be a law in Nigeria that will compel hospitals to accept investigations carried out by any standard facility.
“If a patient has done a diagnostic procedure in any qualified, good and standard facility, it is expected that it should be acceptable at every other hospital, except where investigation done does not meet standard,” Adibo said.
He said that if a hospital or physicians finds any issue, for isnatnce, if the test does not meet clinical expectations, the facility should be made to pay for it and there must be a proof that something is wrong with the investigation.

A 26-year-old Ontario man has pleaded guilty to several charges in connection with the deaths of three people who were in a car he was driving that crashed into a south Edmonton Starbucks location last summer.
In an email to Global News on Thursday, Alberta Justice confirmed Oscar Fabian Benjumea pleaded guilty to three counts of dangerous operation of a vehicle causing death and one count of failing to stop at an accident resulting in death.

On July 3, 2020, emergency crews were called to a single-vehicle collision on Calgary Trail just north of 55 Avenue N.W. at around 2:20 a.m.
A car had crashed into a Starbucks, killing three people inside the vehicle: two women and a man. When crews arrived, however, the driver of the vehicle wasn&#8217;t at the scene. Benjumea was later arrested at his home in the afternoon.

The crash claimed the lives of 32-year-old Faisal Yousef and two women in their 20s: Emma MacArthur and Georgia Donovan.
Benjumea&#8217;s next court appearance is set for May 28. Alberta Justice declined to answer when asked if a sentencing date has been set.

Companies across the United States should be closely following the California State Legislature hearings on the “Silenced No More Act,” which would prevent the use of nondisclosure agreements (NDAs) to silence employees from speaking up about all forms of discrimination and harassment.
The legislation was introduced in response to the stunning claims brought forward by former Pinterest employees alleging a pattern of racial and gender discrimination, harassment and retaliation. They courageously called attention to the hypocrisy of Pinterest’s aspirational comments on social issues even though the company had required them to sign NDAs.
As attorneys who work with shareholders to hold companies accountable for this misconduct, these allegations have deeply impacted our work. They formed the basis of an ongoing shareholder derivative lawsuit that a state pension fund we represent brought against Pinterest’s board of directors and top executives for participating in and otherwise protecting powerful executives who are alleged to have discriminated against Pinterest employees.

The Silenced No More Act would extend existing laws that limit the use of NDAs. Such laws are important because NDAs are intended to protect executives by keeping their harassment, discrimination and retaliation under wraps. That NDAs chill the voices of employees who have already been victimized makes them even more toxic. NDAs cause women to fear reprisal from the company, sometimes even incorporating financial penalty clauses, long after their individual claims have been resolved.
The Silenced No More Act should pass swiftly and be a model for other states, but this is what all companies throughout the country should be doing on their own, rather than waiting for legislation to drag an ethical NDA policy out of them.
Failure to recognize this necessity will lead to future corporate scandals as multiple accounts of the same type of misconduct in the workplace come to light. It will continue to uphold an unsustainable corporate system where executives in positions of power assume they will be protected no matter how unlawful their behavior toward others in the workplace.
We have seen from our investigations the compounding impacts of NDAs and how they allow problems to fester over years.
The two of us, working with others and on behalf of Alphabet shareholders, were part of the team that led a groundbreaking <a href="https://www.cnbc.com/2020/09/25/alphabet-settles-shareholder-lawsuit-.html" target="_blank">$310 million settlement</a> with the tech company that led to historic diversity, equity and inclusion (DEI) reforms at the company. That settlement was the result of a shareholder derivative lawsuit where stockholders alleged that executives and board members violated their fiduciary duties by enabling a double standard that allowed executives to sexually harass and discriminate against women without consequence.
In that case, we believe Alphabet’s “culture of concealment” was driven in large part by the silencing effects of NDAs.
The duration of misconduct, enabled by NDAs, goes far beyond Alphabet and Pinterest. There is no shortage of #MeToo scandals at powerful companies, many with presences in California, that were exacerbated by muzzling NDAs. Weinstein Company, Wynn Resorts, NBC and 21st Century Fox are prominent examples of companies that first tried to keep allegations quiet through the use of NDAs and later faced a firestorm of allegations from former employees.
Fortunately, the landscape surrounding discrimination and harassment in the workplace is changing. Shareholders, workers, customers and other key business stakeholders are becoming more active in demanding that companies stop protecting harassers.
All of this should send a message to boards and C-suite executives that they must set the tone from the top and they are far better off being proactive than reactive. That means actively creating a company culture where DEI is a foundational component &#8212; not an afterthought. It also means intentionally prioritizing transparency and proactively doing away with policies that are antithetical to that goal, like NDAs that are intentionally designed to suppress the voices of employees.
The public and shareholders want to be associated with companies that do right by their employees. Business should recognize this change from a culture of compliance to one of equity and inclusion and embrace this new reality by stopping the practice of requiring complainants to enter into NDAs and fostering a culture of inclusion and accountability.

Don’t wait for laws preventing the use of NDAs. Companies should shape these policies on their own, rather than waiting for legislation to drag an ethical NDA policy out of them.

Don’t wait for legislation banning NDAs: Write ethical policies now

A U.K. company behind digital addressing system What3Words has sent a legal threat to a security researcher for offering to share an open-source software project with other researchers, which What3Words claims violate its copyright.
Aaron Toponce, a systems administrator at XMission, received a letter on Thursday from a law firm representing What3Words, requesting that he delete tweets related to the open source alternative, WhatFreeWords. The letter also demands that he disclose to the law firm the identity of the person or people with whom he had shared a copy of the software, agree that he would not make any further copies of the software, and to delete any copies of the software he had in his possession.
The letter gave him until May 7 to agree, after which What3Words would &#8220;waive any entitlement it may have to pursue related claims against you,&#8221; a thinly-veiled threat of legal action.
&#8220;This is not a battle worth fighting,&#8221; he said <a href="https://twitter.com/AaronToponce/status/1387933438305394690?s=20" target="_blank">in a tweet</a>. Toponce told TechCrunch that he has complied with the demands, fearing legal repercussions if he didn&#8217;t. He has also asked the law firm twice for links to the tweets they want deleting but has not heard back. &#8220;Depending on the tweet, I may or may not comply. Depends on its content,&#8221; he said.

U.K.-based What3Words divides the entire world into three-meter squares and labels each with a unique three-word phrase. The idea is that sharing three words is easier to share on the phone in an emergency than having to find and read out their precise geographic coordinates.
But security researcher Andrew Tierney <a href="https://www.bbc.com/news/technology-56901363" target="_blank">recently discovered</a> that What3Words would sometimes have two similarly-named squares less than a mile apart, potentially causing confusion about a person&#8217;s true whereabouts. In a later write-up, Tierney said What3Words was <a href="https://cybergibbons.com/security-2/why-what3words-is-not-suitable-for-safety-critical-applications/" target="_blank">not adequate</a> for use in safety-critical cases.
It&#8217;s not the only downside. Critics have <a href="https://shkspr.mobi/blog/2019/03/why-bother-with-what-three-words/ " target="_blank">long argued</a> that What3Words&#8217; proprietary geocoding technology, which it bills as &#8220;life-saving,&#8221; makes it harder to examine it for problems or security vulnerabilities.
Concerns about its lack of openness in part led to the creation of the WhatFreeWords. A copy of <a href="https://justpaste.it/39hat" target="_blank">the project&#8217;s website</a>, which does not contain the code itself, said the open-source alternative was developed by reverse-engineering What3Words. &#8220;Once we found out how it worked, we coded implementations for it for JavaScript and Go,&#8221; the website said. &#8220;To ensure that we did not violate the What3Words company&#8217;s copyright, we did not include any of their code, and we only included the bare minimum data required for interoperability.&#8221;
But the project&#8217;s website was nevertheless subjected to a <a href="https://ivan.sanchezortega.es/w3w-bullying/2019-09-19/SCIP%20-%20Ecommerce%20Takedown%20Notice%20-%20W3W%2019%20Sept%202019.pdf" target="_blank">copyright takedown request</a> filed by What3Words&#8217; counsel. Even <a href="https://www.owenboswarva.com/misc/W3W_Twitter_20191007.pdf" target="_blank">tweets</a> that pointed to cached or backup copies of the code were removed by Twitter at the lawyers&#8217; requests.
Toponce — a security researcher on the side — contributed to Tierney&#8217;s research, who was <a href="https://twitter.com/cybergibbons/status/1387164574294712321" target="_blank">tweeting out</a> his findings as he went. Toponce said that he offered to share a copy of the WhatFreeWord code with other researchers to help Tierney with his ongoing research into What3Words. Toponce told TechCrunch that receiving the legal threat may have been a combination of offering to share the code and also finding problems with What3Words.
In its letter to Toponce, What3Words argues that WhatFreeWords contains its intellectual property and that the company &#8220;cannot permit the dissemination&#8221; of the software.
Regardless, several websites still retain copies of the code and are easily searchable through Google, and TechCrunch has seen several tweets linking to the WhatFreeWords code since Toponce went public with the legal threat. Tierney, who did not use WhatFreeWords as part of his research, said <a href="https://twitter.com/cybergibbons/status/1388187147560161282" target="_blank">in a tweet</a> that What3Words&#8217; reaction was &#8220;totally unreasonable given the ease with which you can find versions online.&#8221;
We asked What3Words if the company could point to a case where a judicial court has asserted that WhatFreeWords has violated its copyright. What3Words spokesperson Miriam Frank did not respond to multiple requests for comment.
