The child was known to throw clothes pegs, a remote control, and a tablet off of balconies in the past, prosecutors have claimed.

He has since been cleared by a juvenile court because he is under the age of 14 and therefore can’t be held criminally responsible under Italian law.

But investigators are calling for the teen’s mother and father to be charged with negligent manslaughter.

Officials argue the tragic death of Chiara could have been prevented as the parent’s failed to supervise their son.

The couple have strongly denied any wrongdoing.

They insist they had no involvement in the shock death and claim the statue did not belong to them.

Chiara was struck in the head by a 2kg onyx statuette as she walked through Naples in on a dream holiday with her boyfriend.

Investigators claim that CCTV footage shows the statue was purposely dropped on the unsuspecting couple from a third-floor balcony in the Spanish Quarters of the city.

The statue fell from an estimated 32ft as it shattered once it hit the ground after clipping Chiara.

In distressing video, Chiara can be seen immediately collapsing as her boyfriend Livio – who was just steps behind her – falls to his knees and screams for help.

She was rushed to hospital and went into emergency surgery but tragically died two days later from traumatic brain injuries.

The teen’s parents have been fighting to prove their family’s innocence ever since.

Carlo Bianco, the couple’s lawyer, said in a statement: “This is a tragedy that has struck two respectable families, that of poor Chiara and that of the two professionals.”

He added that the boy has suffered from “ problems” since birth with the pair always showing “great care and protection” towards him.

The couple have even requested the case against their son is reopened so he can be cleared in full rather than simply due to his age.

They want him to be fully acquitted of any wrongdoing, Mr Bianco says.

A preliminary hearing for the parents is scheduled for June 26.

Chiara’s parents are still seeking justice over her death.

Dad Gianfranco Jaconis called the hearing “a step”.

He said: ‘It’s a step we’ve been waiting for. It doesn’t reward us or satisfy us because another hard and tortuous journey lies ahead. But it’s a start.

“The only consolation that will help us face this new tortuous journey, made up of hearings, testimonies, and interrogations, is that we are finally getting to the truth – the one we have always sought.”

Italian-born Chiara worked at luxury fashion brand Prada in Paris.

At a memorial event held last year, Chiara’s mother said: “I invite you to live life in colour, because that’s what she always did.”
