Justice James Omotosho of the Federal High Court in Abuja, on Thursday, rejected Prince Emmanuel Kanu's attempt to represent his brother, Nnamdi Kanu, stating that he is not a licensed legal practitioner.
Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), who was recently convicted and sentenced to life in prison, submitted a new motion requesting to be transferred to a prison in Sokoto.
This application was presented to the court by Emmanuel Kanu.
He informed the court that since it was not feasible for Nnamdi Kanu to appear in person to present the motion, the judge should proceed to hear the case in his absence.
Kanu contended that relocating him to a correctional facility closer to Abuja would facilitate his ability to effectively pursue his appeal.
However, when the case was called, Justice Omotosho did not recognize Emmanuel Kanu's appearance, as he attempted to act on behalf of the IPOB leader.
The judge informed Emmanuel that he could not present the application since he is not a qualified attorney.
“This ex parte motion cannot be presented on behalf of the convict because you are not a legal practitioner,” the trial judge insisted.
He advised the applicant to engage a qualified lawyer or seek assistance from the Legal Aid Council of Nigeria for appropriate legal representation, as mandated by law.
“When I mentioned representation, I did not mean his (Kanu’s) father, brother, sister, or relatives. I meant his counsel.
“I am not addressing the merits of this application at this moment in the interest of justice.
“However, you cannot represent someone when you are not a lawyer; you can only represent a corporate entity.
“Thus, you cannot present the application because you are not a solicitor or advocate of the Supreme Court of Nigeria.
“To qualify as a lawyer, it would require you another six years or so. Therefore, you should seek counsel to present the application,” the judge added.
Understanding the court's position, Emmanuel then requested a new hearing date.
Justice James Omotosho subsequently adjourned the motion to December 8.
