Smirking Bannister was spotted vaping in South London but was back behind bars after breaking rules in his halfway house.

It is understood alcohol was found in his room at a bail hostel in South London.

It had been feared Bannister could target Cheryl again — having already served three prison terms for trying to get to the star.

He had also been jailed for 30 months for manslaughter after attacking a man who died of his injuries in 2012.

Bannister was most recently jailed in September — for breaching a restraining order by appearing at Cheryl and Bear’s home a fourth time that June.

He was due to be locked up for a year but appears to have been released a few weeks ago.

Our exclusive photos show him, straggly hair tied back, holding a vape as he wandered down a residential street on Tuesday.

Smiling Bannister was also seen chatting to two people trying to shelter from rain at a bus stop.

All lags released on licence are required to “be of good behaviour” but Bannister broke the rules at his halfway house.

Last night an HM Prison and Probation Service spokesperson said: “As this case shows, we do not hesitate to send offenders back to prison where necessary if they break the rules.”

and told fans she’s “ready for a new era”.

She told followers: “I’ve really noticed the difference in my skin.

“It’s glowy. There’s no fuss, no drama. Just science doing its thing. It’s a new era for me and I’m ready.”

Last year Cheryl had to take drastic measures including hiring extra security to protect her and her son from Bannister.

In September a judge at Reading crown imposed an indefinite restraining order against Bannister preventing him from contacting Cheryl or from attending or entering any address where he knows or believes her to be.

He had turned up at her ­ mansion in a taxi in June, with Cheryl saying in a ­victim impact statement it left Bear — her son with tragic — feeling “scared”.

On another occasion ­Bannister rang the doorbell and was heard saying: “It’s Dan. I’ve come to get Cheryl.”

In a statement read in court, Cheryl said: “Daniel has been sentenced twice now for this unwanted and scary behaviour towards me.

“Each time he returns, the worry of his intentions intensifies, especially considering his previous offences. It is clear that punishment didn’t deter him or make him understand that this type of behaviour is not OK or acceptable. I am nervous and on edge every time I open the gate to my property. I feel constantly like I have to look over my shoulder everywhere I go. No person should have to feel this way when going about their day-to-day activities.”

She added: “I wish Daniel would stop this intrusive and alarming behaviour and get help with understanding this is completely unacceptable, terrifying and is having a detrimental impact.”

At the time of his sentencing in September for the latest offences, Bannister had already spent three months on remand which could count towards his term.

He was then released at the standard 50 per cent mark — with the rest to be served on licence if he stuck to strict conditions.

Yesterday told The Sun: “Dangerous individuals like Daniel Bannister should be behind bars, not allowed to wander the street and torment their victims.

“Stalking is a disgusting crime that destroys the lives of innocent people — a six-month prison term is pitiful.”

Bannister’s campaign of harassment started in January 2024 and it even continued after Cheryl’s ex Liam died falling from a balcony in Buenos Aires, Argentina, that October.

Cheryl had urged the public to remember Liam was the dad of a young boy, Bear, who “now has to face the reality of never seeing his father again”.

Last year a court was told Bannister believed Cheryl had invited him to her home over Microsoft Teams when he turned up in June.

Prosecutor Leandra Smith said: “He rang her intercom and did not get an answer.

“He returned a few minutes later and rang again. He also peered over her gate.”

The court was shown CCTV footage of the second time Bannister rang Cheryl’s intercom.

The wannabe musician could be seen pressing the button and waving at the camera before walking away.

The court heard Cheryl rang 999, which led to Bannister’s arrest.

He appeared before magistrates that month where he pleaded guilty to a single count of breaching a restraining order.

He was remanded into custody until he was sentenced in September to 12 months in prison.

Bannister was told by His Honour Judge Alan Blake: “If you do, Mr Bannister, have any concern or care towards Ms Tweedy, then I suggest you heed that message which she couldn’t give any more clearly to you in that victim impact statement.

“She does not wish any contact with you and you’re causing her anxiety and terrifying her and her family.”

Judge Blake told Bannister to draw a line through his behaviour, warning: “Or you will find yourself returning to custody for a longer and longer period.”

In 2012 Bannister was jailed for the manslaughter of Rajendra Patel, 48, following a sustained attack at a YMCA hotel in Croydon, South London.

The two men, who both lived at the shelter, were said to be involved in a feud at the time.

Last night a representative for Cheryl was approached for comment about Bannister’s recall.
