The High Court of the Federal Capital Territory (FCT) has scheduled a hearing for 9 December 2025 regarding the suit numbered CV/4502/25, filed by Tonye Patrick Cole against Nyesom Ezenwo Wike, the Minister of the Federal Capital Territory, and Channels Incorporated Limited.

Cole, who was the APC governorship candidate for Rivers State in 2023, is claiming N40 billion in damages due to alleged defamatory remarks made by Wike during a live broadcast on Channels TV’s Politics Today on 18 September.

According to the writ of summons and the accompanying statement of claim, Cole asserts that Wike’s remarks during the live broadcast were false, malicious, offensive, and detrimental to his reputation in personal, professional, and public spheres.

The court documents reveal that Wike referred to Cole in a way that implied financial misconduct and mismanagement of state resources, including claims concerning Rivers State gas and the Olympia Hotel.

Cole’s legal team, led by Jibri Okutepa, SAN, contends that the statements are defamatory as they suggest dishonesty and misconduct, severely damaging Cole’s reputation both nationally and internationally.

The claimant is pursuing N40 billion for alleged damages stemming from what he termed a “malicious, reckless, and unfounded defamatory broadcast and publications,” which resulted in injury, humiliation, mental distress, and reputational damage.

Cole is also requesting N500 million to cover the costs of the legal action, along with several injunctive and declaratory reliefs.

These reliefs include a declaration that the statements were false and defamatory, an order requiring the defendants to retract the claims and remove all copies from all platforms, and a public apology to be aired on Channels TV and published in at least five national newspapers.

Additionally, the claimant seeks a permanent injunction preventing the defendants from further publishing or distributing defamatory material about him.

Cole’s legal team indicated that a pre-action notice and demand letter dated 8 October were served to both Wike and Channels Television; however, the defendants did not comply, leading to the commencement of court proceedings.

The court has instructed the defendants to respond within 21 days of receiving the writ.
