MIGRANTS convicted of rape and sexual assault are claiming PTSD as an excuse to spend less time in prison, it is claimed.
Multiple examples in recent months show asylum seekers having their terms reduced due to the mental disorder, with judges weighing psychiatric evidence against the seriousness of their crimes.

The reductions – which are not done automatically – are leading to criticism from politicians.
, shadow home secretary, told The Times that “illegal immigrants who rape young women should get a full sentence and then be deported, regardless of any asylum or claim”.
He added: “It is an insult to victims that these illegal immigrants are using unverifiable and potentially made-up claims about past trauma to excuse rape and reduce their prison sentences.
“Our justice system should have no truck with this nonsense.”
Abouelela, 42, raped a woman in Hyde Park, . He told a he suffered from “borderline emotionally unstable personality disorder and as a result of experiences in Egypt”.
Judge Perrins said the starting point for the offence was eight years, which he moved to the top bracket, but said he was making a reduction “to take account of your lack of previous convictions”.

He fled the country before serving that sentence. Judge Perrins ultimately sentenced him to eight and a half years.
Another case involved Syrian Hassan Abou Hayleh, convicted in November 2024 of sexually assaulting a 19-year-old woman in Weymouth, , in 2022.
His legal team argued he was suffering from “severe and chronic” PTSD and that prison “would amount to a violation of his human rights”.
The judge ultimately rejected the mitigation and jailed him for two years and 10 months.
Andrii Starovoitov, 33, came to the UK after fleeing before being convicted of molesting a woman at a London train station – however, he avoided jail in November after telling the court he’d “been under a lot of stress” since arriving.
Last week Afghan Jan Jahanzeb and Israr Niazal, both 17, who arrived on small boats, were locked up for raping a 15-year-old girl in Leamington Spa.
They claimed they suffered from mental problems as a result of experiences in their homeland.
Niazal added the he didn’t understand consent “as it does not exist in Afghanistan”.
Judge Sylvia de Bertodano said: “You have betrayed the interests of those like you who come here fleeing harm and seeking safety, and for that you should feel a deep and lasting sense of shame.”
Migrants vanishing from hotels daily
Migrants who fail to claim asylum every day, a whistle blower has claimed.

The absconding asylum seekers reportedly go on to live off cash-in-hand , evading the authorities and living off-grid.
It comes after Labour admitted their – with the total of migrants crossing this year hit 40,000.
